Cuomo’s Corrupt Justice Center is Covering-Up Deaths

ALBANY, NEW YORK, UNITED STATES, September 6, 2018 /EINPresswire.com/ -- The Jonathan Carey Foundation and its founder Michael Carey, who is a well respected civil rights and disability rights advocate, have been shouting from the rooftops that Gov. Cuomo’s abuse hotline is covering-up almost all negligent deaths of people with disabilities. State documents obtained by Carey from the Justice Center itself reveal this fact. County documents also obtained through Freedom of Information Law (FOIL) reveal that most deaths are never reported to county elected district attorney’s or even their county medical examiner or coroner. It is hard to fathom that this level of criminal obstruction of justice surrounding our most vulnerable still exists, but what is written is true.

State documents reveal that between 11-13 people with disabilities die every day within Cuomo’s extremely dangerous and deadly mental health care system. One FOIL reveals that there were almost 3,700 deaths within ten and a half months, simply do the math.

A recent extremely damning investigative news piece surrounding the death of Wally Lassiter and the Justice Center’s handling of deaths speaks volumes.

“Five years after the Justice Center's creation, criminal prosecution of staff whose behavior either directly or indirectly led to a resident's death is still rare. Since 2013, the Justice Center said it has confirmed abuse or neglect in 140 deaths statewide, yet only two cases were prosecuted by local district attorneys.”

These are the numbers that were released from the Justice Center to the Albany Times Union, but these are the watered-down numbers, the Justice Center is falsifying documents and records as well. You can see that less than 2% of these death cases were prosecuted, this is purposeful, wrongful death cases can range from $1,000,000 to $5,000,000 settlements. A FOIL document obtained by Michael Carey from the Justice Center dated August 10, 2016 says;

“Between June 30, 2013 – February 26, 2016: 167 reports alleging abuse and/or neglect that involved the death of a service recipient were made to the Justice Center.”

So the question for the Justice Center is how can the number be 140 for over five years when the numbers of deaths for a little over half that time is 167?

Disability Rights New York (DRNY) tragically is part of the criminal cover-ups of deaths of people with disabilities as documented in their own reports. DRNY is fully aware of and knowledgeable of, just like Governor Andrew Cuomo, that massive numbers of people with disabilities are dying prematurely and that these deaths almost always are never reported to the local police, county medical examiner/coroner or county elected district attorney’s. Here is evidence of what is being alleged;

“DRNY is involved in the OPWDD mortality review process to monitor the deaths of individuals with developmental disabilities in the state’s service system. DRNY has identified trends that have contributed to the untimely death of individuals with ID/DD including: (1) telephone triage (communication between direct care provider and on call nursing to assess need for medical attention); (2) choking; and (3) bowel management.”

To break this down in layman’s terms, large numbers of people with ID –intellectual disabilities and DD –developmental disabilities are dying due to criminal negligence because staff are purposefully not calling 911 to seek immediate medical attention. State and private facilities and group home providers are under-staffing nurses, primarily on evening and night shifts as well as weekends which is gross negligence. The same incompetent administrators are then directing their direct care staff, that are not remotely properly trained, to call a nurse triage hotline in Syracuse New York, instead of calling 911.

Christopher Blair just recently died at Valley Ridge CIT a New York State run facility in Norwich, New York because staff refused to call 911.

Michael Carey has worked for over eleven and a half years to save lives and end the discrimination of people with disabilities. Carey has fought this entire time, day and night, to finally get immediate 911 emergency medical and police services in place to protect 1,000,000 New Yorkers with disabilities since Jonathan his oldest son was killed in the system on February 15, 2007. Jonathan was developmentally disabled and had autism; he was suffocated to death by his caregiver.

It is hard to fathom that there is no law to date requiring mandated reporters and everyone working with our most vulnerable to call 911 regarding medical emergencies, physical and sexual assault crimes or even deaths, but it is true and it must be changed now. This is an outrageous injustice and without question wide-scale discrimination in civil rights similar to what Dr. Martin King Jr. fought against, but for people with disabilities, instead of African Americans.

A vital 911 Civil Rights Bill and Surveillance Camera Bill have been drafted by Carey, both having massive support from New York State legislators, but Governor Cuomo and his allies have done everything possible to block these key life saving and discrimination ending bills from becoming law. Year after year goes by with the number one known reason for these deaths being staff not calling 911. Unconscionably and inhumanely they are being called “untimely” deaths, instead of criminally negligent homicides. Governor Cuomo is denying the basic right and privilege of 911 emergency medical and police services and ‘equal protection of laws’ for 1,000,000 New Yorkers with disabilities.

The New York Times Editorial Board has also brought the fact out into the light that Governor Cuomo is failing to protect the disabled in a very damning Editorial titled, “Protecting the Most Vulnerable”

“There is much the governor could do. He could require surveillance cameras in these facilities, just as prisons have them. He could make sure that the police get more involved.”

Governor Andrew Cuomo has taken no significant actions whatsoever to dramatically reduce the criminally negligent deaths of people with disabilities throughout New York State. Governor Cuomo’s fraudulent and extremely corrupt Justice Center makes sure almost all of these deaths disappear and are covered-up internally. Keeping deaths from 911 and all local authorities is how Cuomo and his cronies are covering up hundreds of deaths.

Federal criminal and civil rights investigations have been requested by Michael Carey.
